A New Hampshire lawsuit seeking to block the state from complying with a request for voter data from the Trump administration's "Presidential Advisory Commission on Election Integrity" is back on, after a renewed request from that commission was sent out Wednesday.
A hearing in a lawsuit seeking to block Secretary of State Bill Gardner from sharing voter information with the commission is now scheduled for the first week of August, at the Hillsborough Superior Court in Nashua.
Earlier this week, a federal judge ruled that the Trump administration's is allowed to at least ask states for their voter information. The commission, which previously put its request on hold pending the outcome of that lawsuit, followed up with a second request to states for "publicly available voter registration records."
The local lawsuit pits the New Hampshire ACLU and two state lawmakers – Democratic State Senator Betty Lasky, of Nashua, and Republican Representative Neal Kurk, of Weare – against Secretary of State Bill Gardner.
The Secretary of State, who is also on the presidential commission that's requesting the data, has said he plans to comply. But the lawmakers and the ACLU argue state law is limited in who can access the statewide voter file, and it doesn't give Gardner the authority to share the data with the commission.
A hearing in the matter was initially scheduled to happen last week, but it was postponed in light of looming questions about the outcome of the federal challenge.
