ACLU Asks Court to Pause Lawsuit Challenging N.H. Voter File Release

A legal challenge to the New Hampshire’s plans to share voter data with the Trump administration has been put on hold, pending other legal challenges at the federal level.

A Superior Court judge in Nashua on Tuesday granted a request from the New Hampshire ACLU to delay a hearing scheduled for this afternoon in the case. The lawsuit is challenging Secretary of State Bill Gardner’s authority to turn over voter checklist information to Trump's commission on election integrity.
 
The commission requested data from all 50 states last month, but is now facing several lawsuits at the federal level, including one from the national ACLU. 
 
Earlier this week, the commission asked states to hold off on sending any information while those cases are pending.  But in light of this new directive from the commission, the New Hampshire ACLU asked the court to hold off on a hearing for the time being — noting that their “request for a preliminary injunction is, at this juncture, no longer necessary.”
 
The New Hampshire ACLU asked to be notified “if the Commission renews its request” or if the Secretary of State moves forward on plans to submit any voter information from here. The judge granted the request within hours of its filing, shortly before the parties were originally scheduled to appear in court.
